Prosecutors Clear Davenport Officer In June Shooting

Prosecutors say a Davenport police officer was defending himself when he shot and killed a man during an ambush back in June.

Scott County Attorney Mike Walton on Thursday cleared Lt. Greg) Behning in the death of Marquis Tousant.

He says Tousant was in a car with five others when they opened fire on a truck full of officers after a violent night in Davenport. Another officer was seriously injured in the ambush. Walton says the officer who opened fire likely saved other officer's lives that night.

“The evidence shows the use of deadly force by Lt. Behning was justified and reasonable under the circumstances,” Walton says. “The actions by Marquis Tousant put the lives and physical safety of the officers in immediate danger. It was reasonable for Behning to return fire to limit further injury or death to others and himself.”
