Surprised that Biden's judicial nominees can't answer legal questions?

It happened again. Senator John Kennedy (R-LA) asked a Biden judicial nominee a straight forward legal question and that person could not answer it.

Around seven weeks ago Spokane County Superior Court Judge Charnelle Bjelkengren was questioned by Kennedy on Article V of the Constitution.

"Tell me what Article V of the Constitution does," Kennedy asked Bjelkengren at that hearing.

"Article V is not coming to mind at the moment," she responded. Then Kennedy asked about Article II and got a similar response.

Which brings us to yesterday. Senator asked Kato Crews, a nominee for district judge of the U.S. District Court of Colorado, how he would "analyze a Brady motion". Crews was stumped.

He answered that with Crews answering that in his four and a half years on the bench, he had not "had the occasion to address a Brady motion".

But Kennedy was not done and asked him if he knew "what a Brady motion is." The answer was simple. Crews said it was "not coming to mind". He was then asked if he knew the Supreme Court Case Brady v. Maryland from 1963. Crews said he thought it had something to do with the Second Amendment. He was wrong.

The Brady decision held that the prosecution must hand over potentially favorable evidence to the defense.
